BOOKING TERMS AND CONDITIONS

 

YOUR CONTRACT IS WITH WANDERLUST YOGA & ADVENTURES LIMITED Company Ltd (Registered number 13071143).  For the purpose of this contract WYA means “the company”.

 

WYA registered office is at 7 RIVERSIDE, HERTFORD, HERTFORDSHIRE, SG14 1QE

 

All holidays and retreats are offered subject to the following Booking Conditions.

1.   Booking procedure

(a) On making a booking, each person travelling accepts the terms of these Booking Conditions.

 

(b) If the booking is made 8 or more weeks in advance payment of a non-refundable deposit of 50% will be due by return at the time of booking. The balance must be paid at least 8 weeks before your departure date.  If the balance is not paid on time, we reserve the right to cancel your holiday, retain your deposit and apply the Cancellation Charge set out in Paragraph 5.

 

(c) For bookings made within 8 weeks of the date of departure, the full payment will become due immediately upon confirmation of the booking. Once payment has been made any subsequent cancellation will incur Cancellation Charges as set out in paragraph 5.

 

(d) Your booking is considered definite once a confirmation email has been sent by us.  No contract will exist between us prior to our issuing the confirmation email.

 

(e) Any additional charges e.g. airport transfers, flight bookings and any service provided outside the core offering will form part of the contract and invoiced amount.

2.   Holiday prices

Retreat prices include accommodation, meals as stated, all yoga classes as stated and any other elements as stated.  Any cost not included in the retreat price will be noted in your booking confirmation.

 

Our prices exclude flights, airport transfers (unless otherwise stated), travel insurance, tips, tours/trips.

3.   Cancellation by you

Only the lead booker in your group may cancel your holiday.  This can be done at any time and must be communicated to us in writing. Cancellation will take effect the day such notification is received by us. As this incurs administrative costs, we will retain your deposit and, in addition, may apply cancellation charges up to the maximum shown below:-

Once your holiday has commenced, no refund or part refund or unused portion of your holiday will be repaid in the event of cancellation by you. Cancellation may be covered by your insurance policy, it is your responsibility to check and make any claim.

 

There will be no refund for additional services including but not limited to flights and airport transfers.

5.   Amendments by us

In the unlikely event we have to make any changes to your holiday, which may include but are not limited to change of itineraries, venue accommodation, yoga teacher or any other change, which we reserve the right to do at any time, you will be advised in writing. Changes are normally minor and we will advise you at the earliest possible date. If your accommodation has to be changed, we will do our utmost to provide accommodation of a similar rating.

 

Whilst we do our best to ensure that the yoga teacher advertised as the teacher for a particular holiday is the one who attends, on rare occasions we may have to change the yoga teacher and reserve the right to do so at any time. This would only happen in case of poor health/injury of the teacher or emergency and we would find a suitable replacement. As all our yoga teachers are of a very high standard, we consider that a change of teacher is a minor change.

 

If a significant change becomes necessary, we will inform you as soon as reasonably possible if there is time before your departure in line with the following conditions:

 

a. Compensation payments will not apply if payment of your holiday has not been received by the stipulated payment date.

 

b. We reserve the right in any circumstances to cancel the retreat, in which case we will offer a refund in full of all monies paid (unless the reason for cancellation is force majeure, see clause 5c).

 

c. Compensation will not be paid if we are forced to cancel or in any way change your holiday due to war, threat of war, invasion, riot, civil war, strike, rebellion, revolution, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, technical or maintenance problems with transport, or other circumstances which amount to force majeure.  Please also ensure you have read and understood our Covid19 statement and policy. 

4.   Insurance and health

YOU MUST HAVE FULL TRAVEL INSURANCE TO COVER MEDICAL EXPENSES AND PERSONAL BELONGINGS INCLUDING COVID19 COVER

 

You are required to have a valid travel insurance policy that covers you for any activities you take part in, you must provide the details of that policy to us in case of emergency. You should also check with your doctor that you are sufficiently fit and healthy to undertake yoga classes and any other physical activity we have arranged during your trip. Please check with your own doctor that you are adequately fit. If you experience any injury or discomfort during any activity organised either by us or yourself, you must stop immediately and advise us.

6.   Cancellation by us

WYA reserves the right in any circumstances to cancel your holiday, in which case we will offer a refund in full of all monies paid.

7.   Flights and your financial protection

Once you have booked and paid for your flights directly with the appropriate airline, we accept no responsibility for any subsequent changes you may wish to make to your flights as, depending on the airline, changes may not be possible. There will be no refunds in respect of the trip you have booked with us for flights you choose to cancel or not to travel on.

 

When you travel with an airline, the conditions of carriage of that carrier apply, some of which may limit liability. Your airline will be responsible for your tickets and any delay or liability.

8.   Our liability to you

a. We accept responsibility for ensuring that the holidays that you book with us are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard. We accept responsibility for the acts and/or omissions of our employees, agents and suppliers except where they lead to death, injury or illness (see below).

 

b. Optional trips booked locally are not our responsibility. However please note the following:-

 

There are risks inherent with any activity retreat and with physical exercise such as yoga.  We strongly recommend that you consult your doctor before travel to advise on your ability to undertake strenuous exercise. You should make him and us aware of any medical condition which may affect your ability and comfort when undergoing vigorous exercise.

9.   Complaints

If you have a problem during your holiday, please inform a member of our team immediately, who will endeavour to put things right. If your complaint cannot be resolved locally, you must advise us in writing on your return. Please note that we cannot guarantee the proportion of males/females in any group, and cannot be responsible for the individual behaviour of any group member or other guest at your accommodation.

10.   Passport, visas and health requirements

You are responsible for ensuring that you have a valid passport and any necessary visas and any necessary or required inoculations or other health requirements. As the UK has left the EU, the government has advised that you will need to have at least 6 months on your passport from the arrival date into the European country. It is your responsibility to check the validity of passport. If you are traveling to a non-EU country then please ensure you have the up to date information on that country.

11.   The contract

This contract is made on the terms of these Booking Conditions, which are governed by English law and the exclusive jurisdiction of the English Courts.

WYA ethics agreement

All Participants on a WYA trip are expected to uphold a high standard of ethics throughout.

 

As a WYA Student I agree to uphold the following ethical principles:

 

a. Conduct myself in a professional and conscientious manner. This includes, but is not limited to, ensuring that I live up to any commitments I make to my fellow students or to the public, and ensuring that my practices and behaviour conform to the representations I make about myself in holding myself out as a yoga practitioner who adheres to certain precepts

 

b. Acknowledge the limitations of my skills and scope of practice

 

c. Create and maintain a safe, clean and comfortable environment for the practice of yoga and meditation

 

d. Encourage diversity by respecting all students regardless of age, physical limitations, race, creed, gender, ethnicity, religion or sexual orientation

 

e. Respect the rights, dignity and privacy of all students

 

f. Avoid words and/or actions that constitute sexual harassment or harassment based on any other characteristics
